- About these Terms
These Terms and Conditions apply to all members, prospective members, day pass users, guests, corporate members and visitors of Raw Gyms. References to “Raw Gyms”, “Raw”, “we”, “us” or “our” mean Raw Condition Ltd trading as Raw Gyms. References to “you” or “member” mean the person using, joining or accessing Raw Gyms or its services. Raw Gyms currently operates at Raw Gyms Sandyford, 2 Burton Hall Road, Sandyford, Dublin 18, and Raw Gyms Donnybrook, Donnybrook House, Dublin, together with our website, online joining pages, Raw Gym Plus app, classes and member services.
By joining Raw Gyms, using our facilities, booking a class, attending as a guest or using our website/app services, you agree to these Terms. These Terms should be read together with our Privacy Policy, Cookie Policy, club rules, health and safety notices and any membership plan details shown to you before you join.
- Membership contract and key terms
Your membership is a contract between you and Raw Gyms. The membership type, price, start date, billing date, joining/admin fee, minimum period, access rights and any offer terms will be displayed to you before you join or otherwise confirmed to you in writing. Unless a fixed-term membership or annual membership is expressly agreed, monthly memberships are rolling monthly memberships. Monthly memberships continue until cancelled in accordance with these Terms.
Membership gives you access to the Raw Gyms facilities and services included in your membership plan, subject to opening hours, health and safety requirements, class availability, capacity management, maintenance, lawful instructions from staff and these Terms. Membership refers to the use of facilities at Raw Gyms Donnybrook and Raw Gyms Sandyford, including attendance at classes, unless your specific membership plan states otherwise.
- Online joining, cooling-off rights and immediate access
Where you join online, by phone or otherwise away from our premises, you may have a statutory right to cancel the contract within 14 days of entering into it, subject to applicable consumer law. If you ask us to start providing services during the 14-day cooling-off period, for example by activating your access, attending the gym, using the app, booking or attending a class or otherwise using membership benefits, you acknowledge that you may be required to pay a proportionate amount for the services provided before you cancel. If the service has been fully performed with your express request and acknowledgement during the cooling-off period, you may lose the right to cancel once the service has been fully performed, where permitted by law. These statutory cooling-off rights are separate from your ongoing contractual cancellation rights for monthly rolling memberships.
- Joining fees, offers and promotional pricing
Joining fees, registration fees, first-month fees, discounted rates and promotional offers are as displayed at the time you join. Offers may be limited by time, location, membership type, capacity, eligibility criteria or availability. Promotional pricing may apply only for the period stated in the offer. After that period, the normal monthly membership fee shown at the point of purchase will apply unless we have agreed otherwise in writing. Raw Gyms may withdraw or amend offers before purchase. Once you have purchased a membership, the terms shown to you at purchase will apply to that membership, subject to the price-change provisions below.
- Entry, app access and swipe cards
All members must use the QR code function in the Raw Gym Plus app for contactless entry unless Raw Gyms provides an alternative access method. To use app entry, you must download the Raw Gym Plus app, complete the required registration steps and ensure your details are accurate so that Raw can activate your access. If you do not wish to use the Raw Gym Plus app, Raw Gyms may provide an alternative adequate method of entry, such as a Raw swipe card, where operationally available. Replacement lost swipe cards may be subject to a replacement fee of €5 per card. You must not share your QR code, swipe card, membership access, app login or any other access method with any other person. Sharing access may result in suspension or termination of membership.
- Age requirements
The minimum age to join Raw Gyms is 17 years with parental or guardian consent. Raw Gyms may require proof of age and/or written consent from a parent or guardian before approving membership or access.
- Health, safety and fitness to exercise
Before using the club, you must familiarise yourself with fire exits, emergency routes and health and safety notices. In an emergency evacuation, employees are not required to search the building for members. You are responsible for following staff instructions, signage and evacuation procedures. Lifts may not be operational during an emergency evacuation. Members are required to comply with club rules and follow health and safety guidance displayed on the premises or communicated by Raw Gyms. New members may be required to watch a Raw health and safety video and complete a health, safety or fitness questionnaire before or during membership. You must provide a correct email address so that onboarding, safety and account communications can be sent to you.
You confirm that, to the best of your knowledge, you are in a suitable physical condition to use gym facilities and take part in exercise. If you have any illness, injury, medical condition, pregnancy-related consideration, disability, pain, symptoms, infection or other concern that may affect your ability to exercise safely, you should seek medical advice before using the facilities and notify an appropriate member of the fitness team where relevant so that your records/programme can be updated or medical clearance can be requested. You must not use club facilities while suffering from any infectious or contagious illness, disease or condition, or while suffering from open cuts, abrasions, open sores or infections where using the facilities may be detrimental to the health, safety, comfort or physical condition of other members, staff or visitors.
- Health data and PAR-Q information
Where you provide health or fitness safety information, such as through a PAR-Q, health questionnaire, onboarding process, personal training consultation, freeze request or incident report, that information will be handled in accordance with our Privacy Policy. Some basic fitness safety information may be required before you use certain services, such as gym access, classes or personal training. Other detailed health information, such as injury history, training limitations or personal fitness goals, is optional unless genuinely required for a specific service or safety reason. Raw Gyms does not use health data for general marketing, advertising profiling or social media targeting.
- Gym rules and member behaviour
Raw Gyms is committed to providing a safe, welcoming and respectful environment for all members, guests and staff. All members and guests must treat others with dignity and respect. Harassment, intimidation, discrimination, abusive behaviour, threatening behaviour, violence, inappropriate sexual behaviour, theft, misuse of facilities or behaviour that creates a health and safety risk will not be tolerated. Members may use gym facilities, including changing areas and restrooms, in a manner consistent with their gender identity. All members are expected to behave respectfully, maintain appropriate gym etiquette and respect the privacy and dignity of others. Members who prefer additional privacy may request alternative changing options where available. Any concerns or complaints should be reported to staff or management so they can be addressed fairly and promptly.
- Equipment, hygiene and use of facilities
Members must use equipment safely and in accordance with instructions, signage, induction guidance and staff directions. If you are unsure how to use any equipment, please ask a member of staff before using it. Members are reminded to use hand sanitiser and sanitising wipes where provided and to wipe down equipment after use. All members must bring and use a towel. Raw Gyms operates a “no towel, no entry” rule where required by club policy. Members must not bring gym bags onto the gym floor. The gym and its facilities must not be abused or damaged. You may be required to pay for damage caused to Raw Gyms property by your reckless, deliberate or negligent act or omission.
- Lockers and personal belongings
Lockers are provided for daily use only and must not be left occupied overnight. Members are responsible for providing a secure lock to protect their property in the lockers provided. Unclaimed property is kept on the premises for a maximum of 7 days and may then be donated to charity or otherwise disposed of. Valuable items may be handled differently at Raw Gyms’ discretion. Raw Gyms is not responsible for loss, damage or theft of personal property except where caused by Raw Gyms’ negligence or where liability cannot lawfully be excluded.
- Parking
Due to the restricted number of parking spaces available at Raw Gyms Sandyford, a two-hour parking limit applies. Cars left on the premises for longer may be subject to clamping, parking enforcement or other parking controls. Raw Gyms is not responsible for parking fines, clamping charges or vehicle issues except where caused by Raw Gyms’ negligence.
- Opening hours, closing procedures and maintenance
Opening hours are displayed on our website and/or at each club and may vary by location, bank holiday, maintenance requirement, event, emergency, safety issue or operational need. Members are required to leave the fitness floors 20 minutes before closing time if they wish to use showers before the club closes. Once a year, or otherwise where reasonably necessary, our clubs may close temporarily for maintenance, refurbishment, health and safety works, equipment installation or other operational reasons. We will aim to give reasonable notice where possible.
- Service interruptions and consumer rights
Raw Gyms will use reasonable care and skill in providing its services. Nothing in these Terms affects your statutory rights under Irish consumer law. Where a facility, class, area or service is unavailable temporarily due to maintenance, health and safety, emergency, staff availability, capacity, events, legal restrictions or matters outside our reasonable control, Raw Gyms will take reasonable steps to minimise disruption. Where a significant interruption affects your membership rights, Raw Gyms will assess the situation fairly and may offer an appropriate remedy, such as an alternative service, extension, credit, price reduction or cancellation option where required by law. Raw Gyms does not guarantee that every class, piece of equipment, instructor, parking space, amenity or facility will be available at all times.
- Classes and bookings
Class access is subject to availability, membership type, booking rules, capacity, instructor availability and health and safety considerations. Raw Gyms may operate booking windows, waitlists, no-show rules and cancellation windows for classes. Raw Gyms may change class timetables, instructors, class types, room allocation or capacity where reasonably necessary. We will aim to provide reasonable notice of material changes where possible.
- Photos, videos, CCTV and social media
CCTV operates in public areas of the club, but not in changing areas, for safety, security, crime prevention, incident management and protection of members, staff, visitors and property. CCTV is handled in accordance with our Privacy Policy and CCTV notices. CCTV is separate from marketing photography and video. By joining Raw Gyms, you do not automatically consent to Raw Gyms using identifiable images or videos of you for marketing or social media.
Raw Gyms may occasionally take photos or videos at events, classes, challenges or club activities. Where we wish to use identifiable images or videos of you for marketing, advertising or social media, we will rely on separate consent or another appropriate lawful basis where permitted. You may withdraw consent for future use at any time by contacting us. We will take reasonable steps to remove or stop using the image where practicable, although content already shared or re-shared by others may not always be fully removable.
- Payments and direct debits
Payment of monthly direct debits, recurring payments or membership fees is due regardless of usage, unless cancellation, freeze, refund, service interruption or statutory consumer rights apply. You are responsible for ensuring that your payment details are valid and that sufficient funds are available on the payment date. If a payment fails, Raw Gyms may reapply for the outstanding amount from your bank account, card or payment method on another date during the month, and may contact you about the failed payment. In the event of default of payment, Raw Gyms may suspend access until payment is brought up to date. Any unpaid balance remains due unless Raw Gyms agrees otherwise in writing or applicable law requires otherwise. Ex-members wishing to re-join may be asked to pay any unpaid balance from a previous membership, together with any applicable joining fee, before a new membership is activated.
- Price changes
Raw Gyms may review and amend membership prices from time to time. Any price change affecting existing monthly rolling memberships will be communicated with at least 30 days’ notice where reasonably practicable. If we increase your monthly membership price, you may cancel your membership before the increase takes effect by following the cancellation process. If you continue using your membership after the new price takes effect, you will be deemed to have accepted the new price. Price changes do not affect fixed-term prepaid memberships during the prepaid term unless the membership terms expressly state otherwise or the change is required by law or tax.
- Freezing membership
After the first 30 days of membership, monthly members may request to freeze their membership for €10 per month for up to 90 days, unless a different freeze rule is stated in their membership plan. The 90-day limit does not apply to annual subscriptions unless expressly stated. To request a freeze, you must submit the Raw Gyms digital freeze request form or email members@rawcondition.com where instructed. Please allow 12-14 working days before your next billing date for the request to be processed. You must provide a reactivation date when requesting a freeze. On that date, your subscription will reactivate and normal membership charges will resume. Charges may be adjusted pro rata if a freeze or reactivation occurs in the middle of a billing period. Freeze requests may be refused where the membership is not eligible, the request is incomplete, the requested dates do not meet the freeze policy or there is an unpaid balance. Raw Gyms will assess freeze requests fairly and consistently. If you wish to cancel while your membership is frozen, you should contact Raw Gyms so the membership can be reactivated or otherwise processed for cancellation. Raw Gyms should not use a freeze to prevent a member from exercising a valid cancellation right, but final payments and notice periods may still apply under these Terms.
- Cancelling monthly rolling membership
Monthly members are subject to a monthly rolling contract and may not cancel during the first 30 days from the first payment date, unless statutory cooling-off rights apply or Raw Gyms agrees otherwise. After the first 30 days, you may cancel your monthly rolling membership by giving 30 days’ notice through the Raw Gyms digital cancellation form or by another cancellation method clearly offered by Raw Gyms. You may request the cancellation link by emailing members@rawcondition.com or by visiting the club and completing the digital cancellation form. Your cancellation is effective from the date and time Raw Gyms receives your properly completed cancellation request, not from the date Raw Gyms processes it, provided the request is successfully submitted through the correct process. Raw Gyms will aim to send confirmation within 2 working days. If you do not receive confirmation, you should contact us promptly so we can check the status of your request. Your final payment will depend on your billing date and the date your cancellation notice is received. You are responsible for paying membership fees due during the 30-day notice period. Where a final part-month amount is required, Raw Gyms may calculate this on a fair pro-rata basis or by reference to your normal billing cycle, as explained to you at cancellation. Monthly fees and prepaid fees are generally not refundable for periods already provided or made available to you, except where required by law, where Raw Gyms has failed to provide the service with reasonable care and skill, where a statutory cooling-off right applies, or where Raw Gyms agrees a refund as a goodwill or complaint resolution measure. Please do not send a cancellation request by post unless Raw Gyms has expressly agreed this with you. Verbal instructions to cancel or amend a membership cannot be accepted because Raw Gyms requires an auditable cancellation record.
- Annual, prepaid and fixed-term memberships
Annual, prepaid and other fixed-term memberships are payable in advance and run for the period stated at purchase. They do not automatically entitle the member to early cancellation or a refund for non-use, change of mind, relocation, illness or other personal circumstances unless required by law, expressly included in the membership terms or agreed by Raw Gyms. Raw Gyms will assess requests for exceptional freezes, transfers, credits or cancellations fairly and on a case-by-case basis, particularly where supported by medical evidence or significant hardship, but this does not guarantee approval.
- Transfer of membership and pre-sale locations
Members wishing to transfer to a club that is currently in pre-sale may only do so once the club is open and accepting transfers. Existing members cannot join a pre-sale offer while already a member unless Raw Gyms expressly agrees. Memberships are personal to the member and may not be transferred, sold or assigned to another person unless Raw Gyms agrees in writing.
- Suspension, refusal of entry and termination by Raw Gyms
Raw Gyms may refuse an application for membership or entry to the club where there is a legitimate reason, including capacity, safety, previous misconduct, unpaid balances, false information, breach of rules or risk to staff, members, visitors or property. Raw Gyms may suspend or terminate membership if: (a) you commit a serious or repeated breach of these Terms or club rules and, where the breach is capable of remedy, fail to remedy it within 7 days of receiving notice; (b) any part of your membership fee remains unpaid 30 days after its due date; (c) you provide information that you know to be false when applying for membership and the false declaration would reasonably have affected our decision to grant membership; (d) you share access credentials or allow unauthorised access; (e) you behave in a way that threatens safety, dignity, welfare, good order or the respectful environment of the gym; or (f) capacity limits or safety requirements mean membership must be adjusted or cancelled. Where appropriate, Raw Gyms will give the member an opportunity to respond before termination. However, Raw Gyms may immediately suspend access where necessary to protect safety, security, staff, members, visitors, property or the integrity of the business.
If membership is terminated because of serious misconduct, non-payment, fraud, abusive behaviour, violence, harassment, theft, damage, sexual activity on premises, serious safety breach or similar conduct, Raw Gyms may refuse a refund of joining fees and unused membership fees to the extent permitted by law. Refunds in other termination situations will be assessed fairly in the circumstances and in accordance with consumer law.
- Prohibited conduct
Any sexual activity is prohibited within Raw Gyms clubs. Members or guests participating in sexual activity may be asked to leave immediately, suspended and/or have membership terminated. In severe cases this may result in immediate cancellation of membership without refund, to the extent permitted by law. Raw Gyms may also take action where a member or guest engages in harassment, intimidation, discrimination, threats, violence, theft, vandalism, drug misuse, filming/photographing others without permission, unauthorised commercial activity, unsafe training, misuse of emergency equipment or any other conduct that Raw Gyms reasonably considers detrimental to staff, members, visitors, safety or the business.
- Liability
Raw Gyms accepts liability for death, personal injury, damage, accident or loss caused by Raw Gyms’ negligence or the negligence of its employees or agents acting in the course of their duties, or where liability cannot be excluded or limited by law. Raw Gyms is not responsible for loss, damage, injury or expense caused by: (a) your own fault, negligence or breach of these Terms; (b) a third party unconnected with Raw Gyms’ provision of services; (c) events which Raw Gyms could not reasonably have foreseen or prevented even with reasonable care; (d) your misuse of facilities or equipment; or (e) your failure to follow health, safety, medical or staff guidance. Nothing in these Terms limits or excludes your statutory rights as a consumer.
- Complaints and comments
Members and guests are encouraged to make comments or complaints by emailing members@rawcondition.com. Please include your full name, contact details, home club, membership details if applicable, and a clear description of the issue so that our team can investigate and respond. You may also ask to speak to the manager on duty or the General Manager. Raw Gyms aims to acknowledge or respond to complaints within 48 hours where reasonably possible. More complex complaints may take longer to investigate. Written and verbal complaints may be discussed internally and tracked until resolved. Personal data in complaints will be handled in accordance with our Privacy Policy.
- Corporate membership
These corporate membership terms apply in addition to the standard Raw Gyms Terms and Conditions.
Where you apply for corporate membership, company identification may be required, such as a company identification card, work email address or payslip issued within the previous 3 months. Corporate membership is available to employees of specific corporations or groups approved by Raw Gyms. Please contact Raw Gyms directly for more information.
Where an existing member wishes to avail of a corporate offer, this can normally be done at renewal only. No refund on an existing membership will be processed solely because a corporate offer later becomes available, unless Raw Gyms agrees otherwise. If your eligibility for corporate membership ends, Raw Gyms may transfer your membership to the applicable standard rate after giving reasonable notice.
- Assignment and changes to these Terms
Raw Gyms may assign or transfer the benefit of a membership agreement to a third party where this is connected with a business sale, restructuring, transfer of assets, group reorganisation or similar legitimate business reason, provided your rights are not materially reduced. Raw Gyms may update these Terms from time to time. Changes will be published on the website and, where they materially affect existing members, communicated with reasonable advance notice. If a change materially disadvantages you, you may have the right to cancel before the change takes effect.
- Privacy and communications
Your data privacy and security are important to us. Please refer to our Privacy Policy, which explains how we collect, use, store and share personal data, including membership data, payment data, app data, CCTV, health/PAR-Q information, marketing preferences and rights requests. Raw Gyms may communicate with members by email, SMS, phone, app notification, website notice or in-club notice for operational, administrative, safety, billing, service, legal and customer-service reasons. These service communications are not marketing and may still be sent even if you opt out of marketing.
- Governing law
These Terms are governed by the laws of Ireland. The Irish courts will have jurisdiction, subject to any mandatory consumer rights that apply.
